INTRODUCTION
These Terms of Service apply when you access and use PRECEPTOR IA and other software, tools, services, documentation, content, features, and generative AI capabilities that we make available to you through any digital means or channel. These Terms are a legally binding agreement between you and PORTAL MOVENTE CONHECIMENTO EM SAÚDE LTDA., CNPJ No. 43.298.599/0001-02, headquartered in Belo Horizonte/MG. By using PRECEPTOR IA, you agree to be bound by these Terms, the Privacy Policy, and any other applicable terms and policies ("Product").
Preceptor-IA is a clinical support tool that provides information from a database and does not replace the judgment or responsibility of the healthcare professional using the tool for consultation purposes.

USER COMMITMENTS
1.1 Without limiting these TERMS OF SERVICE – PRECEPTOR IA or any other applicable terms or policies, you may not access the Product and/or use our Services if you are under 18 (eighteen) years old or if you are not permitted to receive/use the Product/Services under applicable laws.
1.2 The use of the Product is personal and non-transferable. A "User" is any person who visits, accesses, or registers on Our Channels, regardless of whether they make a final acquisition of Our Services.
1.3 The User is solely and exclusively responsible for the access, understanding, and intended use of the information and results obtained from the searches/queries made using the Product.
1.4 If the User has a profession regulated by law and specific regulations, including doctors and healthcare professionals, they must be aware of all requirements, limits, prohibitions, and implications related to their profession. The use of the Product/Services as a management, research, or guidance tool, or for any other purpose, does not in any way exempt them from the responsibility of acting within legal and regulatory parameters. They must be qualified and possess the necessary competencies required for professional practice. Under no circumstances may the User claim or attribute any success and/or failure in their professional practice to the results/materials/information obtained through the use of the Services and Products.
1.5 The User may not access, use, or allow others to access or use the Product in any way that may:
Be illegal or involve conduct that promotes, contributes to, disseminates, facilitates, supports, or encourages illegal or illicit activities.
Generate, promote, disseminate, or otherwise use the Product to cause harm or damage to third parties, including but not limited to harm related to health, image, or physical and/or mental integrity.
Pose a risk of death or bodily injury to individuals (including in relation to procedures and medical recommendations, misuse of substances, including medication, among others).
Deceive or mislead others, including but not limited to activities related to plagiarism, scams, phishing or malware, and the promotion of misinformation.
Generate, promote, disseminate, or otherwise use or facilitate content that may violate or infringe the rights of third parties (including but not limited to intellectual property rights and privacy rights).
Seek professional advice, including but not limited to medical advice, in the capacity of a patient, as a substitute for a medical consultation with a qualified professional.
CONTENT RIGHTS
2.1 PRECEPTOR IA allows you to provide materials for processing, which may include text, documents, images, or recordings, depending on the integration (collectively, "Interactive Commands"), and will generate a response ("Results") based on your Interactive Commands, as well as any feedback you provide ("Feedback") (collectively, "Content"). You may not provide Interactive Commands or use AI in any way that infringes or violates another person's rights, including intellectual property rights.
2.2 Except as expressly provided in these Terms, you retain all rights, titles, and interests, including any intellectual property rights, that you have in your Interactive Commands. You agree that providing Interactive Commands will not violate these Terms and other applicable policies.
DATA PROVISION
3.1 Our treatment of personal information processed through Our Channels is governed by the Privacy Policy, which explains how we collect, use, and share personal information, including that which you submit as Interactive Commands, Feedback, or other Content, your activity on our products, and personal and third-party information we collect from your submissions.
3.2 When information is shared on Our Channels, it may be retained and used by the software/application/system to provide specific and/or more personalized Results. Do not share information about yourself or others unless you are authorized to do so or are willing to share it.
3.3 If the Product cannot respond to your question or our systems determine that a more relevant or current response can be provided by a partner, we may ask a third party to provide the response. For example, in such cases, we may share questions in a Prompt and limited PRECEPTOR IA data with a third-party search engine and include those results in the response.
3.4 The information we share with third parties may contain personal information if your Prompt includes personal information about anyone. By using our Products/Services, you are instructing/authorizing us to access and share your information with third parties when it enables more relevant or useful responses.
3.5 These third parties will use the information we share, which may include personal information about you or others if included in your Prompt, in accordance with their own privacy policies.
3.6 Movente declares that the processing of personal data within the scope of services provided by PRECEPTOR IA is in compliance with Brazilian Law No. 13.709/2018 – General Data Protection Law (LGPD). Data collected is handled based on the principles of purpose, adequacy, necessity, free access, data quality, transparency, security, prevention, non-discrimination, and accountability. Data subjects may exercise their rights under the LGPD through the contact channels listed in this document.
3.7 In some cases, PRECEPTOR IA may review your interactions with AI, including the content of your conversations or messages. This analysis may be automated or done manually (by a human).
3.8 User personal data and interactions may be stored for the duration necessary to fulfill the purposes described in these Terms or as required by legal and regulatory obligations. After this period, the data may be deleted or anonymized, as applicable.
3.9 By using PRECEPTOR IA, the user expressly agrees to the sharing of information with third parties when necessary to provide more complete, useful, or updated responses, as detailed in the Privacy Policy.
ACCURACY LEVEL
4.1 Our Products and Services involve artificial intelligence technologies that are still evolving.
4.2 PRECEPTOR IA is a technological tool that incorporates other applications and developing technologies, and its accuracy is continually improving. Therefore, the accuracy of any content, including Results, cannot be guaranteed. These Results may require prior knowledge, technical training, and the intellectual comprehension of the User to be correctly interpreted. You should not rely solely on the Results provided by PRECEPTOR IA to guide your decisions, including but not limited to medical or health-related recommendations. If you choose to use the Results for any reason, you do so at your own responsibility and must verify their accuracy.
4.3 We make no guarantees that the AI technologies used in our Products and Services will always be secure, error-free, or function without interruptions, delays, or imperfections. We are not responsible for the Results, and you are solely responsible for verifying their accuracy and relevance. The Results generated by the AI systems through our Products/Services do not reflect the opinions of the companies that developed the Product.
CONTENT DISCLAIMER
5.1 The AI will generate Content based on the Interactive Commands you provide. The specific Content generated cannot be predicted in advance. The AI may generate content you find offensive or questionable and/or that does not represent the views of PRECEPTOR IA. By agreeing to these terms and using the AI, you acknowledge and accept the risk that your Interactive Commands may produce content that is offensive or questionable to you. You also acknowledge and agree that you, not PRECEPTOR IA, are responsible for your use of and any actions related to content generated by the AI based on your Interactive Commands.
PRECEPTOR IA'S RIGHTS REGARDING CONTENT
6.1 PRECEPTOR IA may use the Content and related information, including through automated or manual (human) analysis and by third-party providers, for the following purposes:
Maintenance and service improvement.
Conducting and supporting research.
Monitoring your use of the Product/Services for compliance with these Terms and other applicable policies and laws, and for reporting legal or regulatory violations as required by law.
Suspension and/or removal of accounts that violate these Terms and/or our other applicable terms and policies.
6.2 We implement technical and administrative measures to ensure the security and protection of data collected and processed through PRECEPTOR IA. These measures include access control, encryption, two-factor authentication, system monitoring, and internal information security policies.
6.3 PRECEPTOR IA may record logs of access, commands, interactions, and user actions for security, traceability, audit purposes, fraud prevention, and compliance with legal obligations.
SUSPENSION AND TERMINATION
7.1 If we determine that you have violated these Terms or our other applicable terms and policies, we may suspend or permanently disable your access to PRECEPTOR IA and the services or features we offer.
7.2 We may also disable or delete your account permanently if legally required to do so.
7.3 In such cases, fees related to services already rendered will not be refunded. Only payments made for services not yet delivered may be refunded.
7.4 Upon account closure or deletion request, personal data may be exported or deleted per the user's express request, respecting applicable technical and legal limitations.
PRODUCT OWNERSHIP
8.1 All rights related to ownership and title of Our Products and Services, including intellectual property rights over PRECEPTOR IA, belong to us.
8.2 Except for the access and usage rights expressly granted in these Terms, no other rights, titles, or interests in PRECEPTOR IA are transferred to you.
THIRD-PARTY MATERIALS
9.1 The AI may use or be used in conjunction with third-party content, services, features, and integrations. We are not responsible for your use of third-party content, services, features, or integrations, which you access at your own risk.
9.2 By agreeing to these terms, Users acknowledge and accept that our Products and Services are delivered through the WhatsApp platform/application. Your prior installation and use of WhatsApp on your device implies your express agreement to WhatsApp's own terms of service. Our activities are not linked to or governed by WhatsApp's policies, for which only WhatsApp is responsible.
LIMITATION OF LIABILITY
10.1 PRECEPTOR IA involves the provision of services with professional diligence and in accordance with these Terms. As long as we have acted with such diligence, we are not liable for losses not caused by our breach of these Terms or otherwise by our actions; losses that were not reasonably foreseeable by you or us at the time of accepting these Terms; and events beyond our reasonable control.
10.2 Any disputes related to the use of Our Products and Services shall be submitted to the competent court in the District of Belo Horizonte/MG.
SEVERABILITY
11.1 If any part of these Terms is found to be unenforceable, it shall be revised to the extent necessary to become enforceable. If the provision cannot be made enforceable, it will be removed, and the remainder will remain in full force and effect. Our failure to enforce any part of these Terms shall not be deemed a waiver. Any changes or waivers to these Terms must be made in writing and signed by us.
UPDATES TO THESE TERMS
12.1 We are constantly working to improve our services and develop new features to enhance our Products for you and our community. As a result, these Terms may need to be updated periodically to reflect our services and practices accurately, promote a safe experience, and/or comply with applicable laws. Unless changes are required to meet legal obligations, you will be notified (e.g., by email or in-app notification) of any changes made to these Terms and have the opportunity to review them before they take effect. Once the updated Terms are in effect, you will be bound by them if you continue to use our AI services. If you do not agree with the updated Terms, you must stop using the AI before they take effect.
